Welcome to Avatar Arc! These are the rules of the road for using our website https://avatararc.ai/ and all related services (“Services”) provided by AI Creations (ABN 24545074491). By creating an account or using our Services, you agree to these Terms.

If you don’t agree with these terms, then don’t use our Services.

1. Who Can Use Our Services

• Age Requirement: You must be at least 13 years old to use Avatar Arc. If you are between 13 and 18, you confirm that you have permission from your parent or legal guardian to use the Services.
• Account Creation: To access our Services, you’ll need to create an account. Please use accurate information and keep it up to date.
• Your Account, Your Responsibility: You are responsible for keeping your account login details secure. You are allowed one account per person. Creating multiple accounts to abuse our policies or trial systems is not permitted and may result in a ban.

2. Our Services

• What We Do: Avatar Arc is an AI Chat platform designed to let you engage in conversations with various “AI Avatars”.
• About the AI: The AI models we use are provided by third-party services (like OpenAI, Google, etc.). AI is an evolving technology and can sometimes produce inaccurate, biased, or unexpected responses. You are responsible for how you use the AI-generated content. Use your judgment and don’t rely on the AI for critical advice (medical, legal, financial, etc.). The conversations are fictional.
• Content Ownership: You own the content you create. The prompts you write and the conversations you generate are yours.
• Service Changes: We are always working to improve Avatar Arc. This means we may add, change, or remove features at our discretion. We will do our best to provide notice of any significant changes.

3. Subscriptions, Payments, and Trials

• Subscription Plans: Access to certain features of Avatar Arc requires an active, paid subscription. We may also offer a free plan with limited access.
• Billing: Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually). Your subscription will automatically renew at the end of each billing cycle unless you cancel it.
• Cancellation: You can cancel your subscription at any time from your account settings. The cancellation will take effect at the end of your current billing period, and you will retain access to paid features until then.
• Refunds: Subscription payments are non-refundable. We do not provide refunds or credits for partially used subscription periods. We may review refund requests on a case-by-case basis for exceptional circumstances.
• Free Trials: We may offer a free trial to new users. At the end of the trial period, you will need to purchase a subscription to continue using the paid features.
• Price Changes: We may change our subscription prices from time to time. If we do, we will give you reasonable advance notice of any price changes.

4. Fair Use and What Not To Do

We trust you to use Avatar Arc responsibly. You agree not to use the Services to:

• Generate content that is illegal, harmful, or promotes hate speech, violence, or discrimination.
• Create content that infringes on anyone’s privacy or safety.
• Engage in any fraudulent or deceptive activities.
• Generate sexually explicit material.
• Abuse the platform by trying to bypass our security measures, overload our servers, or use automated scripts in a disruptive way.
• Sell, copy, or exploit any part of the Service without our express written permission.

We reserve the right to suspend or terminate accounts that violate these rules.

5. Your Content and Our License

• You Own Your Content: To be clear, you retain full ownership of the conversations and content you generate (“User Content”).
• Our License to Operate: By using the service, you grant us a limited license to store, process, and display your User Content, but only as necessary to provide the Service to you.
• We Don’t Train on Your Data: We do not use your private User Content to train our AI models.

6. Suspension and Termination

• By You: You can stop using our Services and cancel your subscription at any time.
• By Us: We reserve the right to suspend or terminate your account if you violate these Terms or use the Services in a way that is unlawful or harmful to others. We will try to provide notice before we do.
• Dormant Accounts: We may remove accounts that have been inactive for a long period. We will attempt to contact you before we do.

7. Disclaimers and Limitation of Liability

• “AS IS” Service: The Services are provided “AS IS” and “AS AVAILABLE” without any warranties. We don’t guarantee that the service will be perfect, uninterrupted, or error-free.
• Limitation of Liability: To the fullest extent permitted by law, AI Creations will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. You are responsible for your use of AI-generated content.

8. Indemnification

You agree to defend and indemnify AI Creations and its employees from any claims, damages, or expenses (including legal fees) arising from your use of the Services or your violation of these Terms.

9. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will notify you by posting a notice on our website or sending you an email. Your continued use of the Services after the changes take effect means you agree to the new Terms.

10. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be handled in the courts of Australia.
